Regarding the Export of Vehicles to Belarus

We would like to remind you that Council Regulation (EU) 2024/1865 of 29 June 2024, amending Regulation (EC) No 765/2006 concerning restrictive measures in view of the situation in Belarus and Belarus’s involvement in Russia’s aggression against Ukraine, introduced a new Article 1bb into Regulation (EC) No 765/2006. Paragraph 1 of this Article provides that:

“It shall be prohibited to sell, supply, transfer or export, directly or indirectly, goods listed in Annex XVIII, whether or not originating in the Union, which could contribute in particular to the enhancement of Belarusian industrial capacities, to any natural or legal person, entity or body in Belarus or for use in Belarus.”

Please note that, when determining whether restrictions on the supply, transfer or export of passenger vehicles to Belarus apply, the vehicle’s overall characteristics are assessed, including:

  1. Type of engine – petrol or diesel internal combustion engine, hybrid electric powertrain, electric motor, or another type of engine;

  2. Engine displacement – where the engine displacement exceeds 1,900 cm³ (applicable only to vehicles equipped with a petrol or diesel internal combustion engine);

  3. Ground clearance – where the vehicle’s ground clearance is 165 mm or more.

Important! From a customs law perspective, a vehicle leaving the European Union for a third country is considered an export, even though the driver will generally not be required to complete a standard electronic export declaration. Therefore, before travelling to Belarus, it is necessary to assess whether the vehicle falls within the scope of the applicable prohibitions.
